Non-Identifiable or Aggregated Data
When you interact with City Dining Cards through the Services, we also receive and store certain personally non-identifiable information. Such information, which is collected passively using various technologies, cannot presently be used to specifically identify you. City Dining Cards may store such information itself or such information may be included in databases owned and maintained by City Dining Cards’ affiliates, agents, business partners, or service providers. We may use such information and pool it with other information to track, for example, the total number of visitors or users of the Services, the number of visitors to each page of our website, the domain names of our visitors’ Internet service providers, and how our users use and interact with the Service. Also, in an ongoing effort to better understand and serve the users of the Services, City Dining Cards may conduct research on its customer demographics, interests and behavior based on the Personal Data and other information provided to us. This research may be compiled and analyzed on an aggregate basis. City Dining Cards may share this non-identifiable and aggregate data with its affiliates, agents, business partners, or service providers. There are several areas on the Website and/or within the Application where you may be asked to enter both personal and non-personal information including, but not limited to, your name, address, phone number, credit card information, birthday, Facebook and/or Twitter usernames, and information regarding your cell phone and/or other mobile device. In addition, when you use the Application, City Dining Cards automatically receives and records information on our server logs from your browser or mobile platform, including your IP address and location. City Dining Cards also collects and uses additional information from users such as, but not limited to, redemption location, purchase activity, Application open date and time, idle time, and all clicks and/or swipes within the application (together with time and order), redemptions, favorites, rewards, amount of purchase, viewed cards, promotional activities, and friend information. City Dining Cards may also collect information posted by users on social media sites for users that have opted to connect to or otherwise link City Dining Cards with social media accounts including Facebook and Twitter. We treat this data as non-personal information for purposes of providing the Services, except where we are required to treat it as personal information under applicable law. We DO NOT sell or share any personal information about you to or with any person or organization except (i) as authorized by you, (ii) as set forth in the relevant portion of the Website, Application or within any agreement between us, (iii) in connection with providing various products or Services to you (either directly or through one or more third parties), (iv) as may be required by law or court order, or (vi) as otherwise set forth herein. In particular, and not in limitation of the foregoing, information you enter at the Website and/or Application (i) will be shared with the merchants or third party service providers with which City Dining Cards has entered into a business relationship to provide the Services, and (ii) may be shared with various third parties in connection with making available to you certain offers (which offers may be based on or related to your location at the time the offer is made available to you). In addition, City Dining Cards may sell, disclose or otherwise use information gathered on the Website or within the Application to third parties on an aggregated basis.
More About the Information We Collect
(a) Information we receive from you. To use certain City Dining Cards’ Services and/or to access the Application, you will need to provide certain personal information which may include, without limitation, your name, address, birthday, phone number, credit card information, Facebook and/or Twitter user names, e-mail address, information regarding your cell phone or mobile device and other information.

In order for City Dining Cards to ensure that we are providing the best possible consumer experience on the Website and within the Application, we collect and track certain user information. Cookies are files with small amount of data, which may include an anonymous unique identifier, sent from the computer that hosts our Services. Cookies are sent to your browser from a web site and stored on your computer’s hard drive. When you visit the Website, our Web server may send a cookie to your computer. This cookie is intended to store a limited amount of information about your site visit. City Dining Cards may also utilize Web Logs to track aggregate information about how our site and/or the Application is being used. Web Logs track anonymous user information, including the number of visitors to the Website, operating systems, Internet Provider addresses (if publicly available), browser type, browser version, the pages of our Website that you visit, the time and date of your visit, the time spent on those pages and other statistics. Unlike cookies, Web Logs are maintained only on City Dining Cards servers and do not store or place anything on the user’s computer.
If you come to the City Dining Cards Website from an online banner ad, an anonymous identification number may be passed to the Website. This information will not gather any personally identifiable information about you. It will only track the overall effectiveness of our online advertising, marketing and banner advertisement campaigns.

To the extent you have obtained or redeemed a discount offered by a merchant (“Discount Providers”), designated a Discount Provider as a favorite on your account or otherwise participated in any other activity sponsored or offered through the Service on behalf of the Discount Provider, we may provide such Discount Providers with your Personal Data (a) in order for the Discount Provider to redeem and validate your reward, send you customized offers, troubleshoot redemption, combat fraud and otherwise communicate with you, (b) as part of legal proceedings affecting City Dining Cards and the Discount Provider, or (c) to facilitate a direct relationship between the Discount Provider and you.
As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets.
Agents, Consultants and Related Third Parties
City Dining Cards, like many businesses, sometimes hires other companies to perform certain business-related functions. Examples of such functions include maintaining databases, sending emails and SMS messages, offering and developing certain features of the Services, and maintenance and security. When we employ another company to perform a function of this nature, we only provide them with the information that they need to perform their specific function. We also disclose automatically collected data (redemptions, favorites, rewards, viewed cards, promotional activities, and redemption information) to our Discount Provider, third-party ad servers and advertisers. These third parties may match this data with information that they have previously collected about you under their own privacy policies, which you should consult on a regular basis.
Your Public Profile
If you make any information available through your public profile, it will be made available to members of the City Dining Cards community. Please note that your first name and last initial and photo are, by default, available on your public profile. Your phone number, email address, and birthday are private and will not be displayed publicly as part of any profile.
City Dining Cards may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation or assist government enforcement agencies, (ii) protect and defend the rights or property of City Dining Cards, Discount Providers, or our users, (iii) act in urgent circumstances to protect the personal safety of users of the Services or the public, (iv) protect against legal liability; (v) protect Discount Providers from fraudulent, abusive, or unlawful uses; or (vi) protect the security or integrity of the Services.
Ability to Opt-Out
We do not share Personal Data with other third-party organizations for their marketing or promotional uses without your consent except as part of a specific program or feature for which you will have the ability to opt-out. We may offer contests that require you to take an action to receive a reward. This data is provided to the advertiser. You will always have the option not to participate.
The Services will automatically send you SMS messages with updates and other information as part of the Services. You may stop receiving SMS messages from the Services generally by replying STOP in response to any received SMS from the program. You may also opt-out of receiving SMS messages on the City Dining Cards website. If you opt-out of receiving SMS messages, you may not be able to use certain Services.
You can use our website without providing any Personal Data. If you choose not to provide any Personal Data, you may not be able to use certain Services.

Integrating Third Party Services within the Services
One of the special features of the Service is that it allows you to enable various online third party services, such as social media and social networking services (“Third Party Services”), to be directly integrated into your City Dining Cards experience. To take advantage of this feature, we will ask you to provide us your username and password for the relevant Third Party Services. By enabling such Third Party Services, you are allowing us to pass your log-in information to these service providers for this purpose. When you add a Third Party Service account to the Service, we will collect your login information and other relevant information necessary to enable the Service to access that Third Party Service and your data contained within that Third Party Service. However, please be aware that the manner in which Third Party Services use, store and disclose your information is governed solely by the policies of such third parties, and City Dining Cards shall have no liability or responsibility for the privacy practices or other actions or inactions of any Third Party Service that may be enabled within the Service.
City Dining Cards takes reasonable steps to protect the Personal Data provided via the Services from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure or error free.
